Adventure Spirit – 4WD Self Drive Tours
1. BUSINESS CONDUCT LAW – INTERPRETATION
i. Contractual Agreement and Legal Framework.
These Terms and Conditions ("Booking Conditions") govern the legal relationship between you (the “Traveller”) and Adventure Spirit Pty Ltd (the “Travel Organiser”), registered in Australia and operating under the laws of the Commonwealth of Australia. By confirming your booking, you acknowledge that you have read, understood, and accepted these Booking Conditions. All services provided are subject to applicable Australian consumer law and relevant state and federal legislation.
ii. Acceptance of Terms and Amendments.
By accessing and using the Adventure Spirit website (www.adventurespirit.com.au), and/or by entering into communication with us via email or telephone to book a self-drive or guided expedition, you agree to be legally bound by these Terms and Conditions. Adventure Spirit Pty Ltd reserves the right to amend or update these Conditions at any time prior to booking confirmation, without prior notice. Any obvious clerical or typographical errors in our published travel itineraries or website content do not constitute a binding offer and may be corrected without liability.
2. BOOKINGS
i. A booking with Adventure Spirit Pty Ltd (the “Travel Organiser”) is confirmed only when all of the following conditions have been met:
a. You have submitted a completed booking request with all required personal details, including full names as per passport, and any additional details requested upon booking process. The name provided at the time of booking must exactly match the name on your valid passport. Any discrepancies may result in additional fees or travel disruptions for which Travel Organiser is not responsible.
b. Deposit of AUD 2,000 per person has been received by us within 7 days of the booking request;
c. You have received a written Booking Confirmation from us, via email.
ii. Upon issuance of the Booking Confirmation, a binding contract between you (the “Traveller”) and the Travel Organiser will be deemed to have been formed.
iii. You must be at least 18 years of age to make a booking. Minors may participate only with the consent of a legal guardian and under specific conditions agreed upon in writing.
iv. If the deposit is not received within the specified timeframe, your booking request may be cancelled without notice.
v. Requests to amend an existing booking must be submitted in writing via email to Adventure Spirit Pty Ltd as early as possible. While we will make reasonable efforts to accommodate changes, all amendments are subject to availability and might incur additional costs.
3. PAYMENTS
i. To confirm your place on an expedition, the following payment terms apply:
a. Deposit: AUD 2,000 per person is required within 7 days of submitting your booking request.
b. Final Payment: The remaining balance must be paid in full no later than 180 days before the scheduled departure date.
ii. Failure to make payments on time may result in cancellation of your booking:
a. If final payment is not received by the due date, a payment reminder will be sent via email.
b. If payment is not made within 7 days of the reminder, the booking will be automatically cancelled, and the deposit will be forfeited.
iii. We accept payment via bank transfer or credit card. Please note that credit card transactions are subject to a processing surcharge between 1.75% and 2.8%, depending on the card type. All payments must be made in Australian Dollars (AUD).
a. Traveller is responsible for any bank fees, international transaction charges, or currency exchange costs related to the payment.
b. We do not accept cash or cheque payments.
c. Booking is not considered fully confirmed until the full payment has been received and processed.
4. CANCELLATIONS & REFUNDS
i. All cancellation requests must be submitted in writing via email and will be effective from the date received by Adventure Spirit Pty Ltd.
ii. The following cancellation fees apply, based on the number of days before the scheduled expedition departure:
a. More than 180 days: AUD 2,000 per person (deposit is forfeited).
b. 60–179 days: 50% of the total tour cost.
c. Less than 60 days: 100% of the total tour cost (no refund)
NOTES:
These fees reflect the substantial planning, booking commitments, and administrative costs involved in organising our expeditions.
No refunds will be provided for unused services, early departures, delayed arrivals, or no-shows.
We strongly recommend that you obtain comprehensive travel insurance covering cancellation, medical expenses, personal liability, and loss of luggage or personal items.
iii. We reserve the right to cancel a tour for reasons beyond our control (e.g. natural disasters, border closures, safety concerns, minimum participant numbers not met). In such cases:
a. Traveller will be offered an alternative tour date or a full refund of all payments made (excluding flights or services not booked through us).
b. We will not be liable for any other costs incurred by you, including flights, insurance, or third-party arrangements.
iv. We are not liable for any cancellations, delays, or changes to your tour that result from circumstances beyond our control, including but not limited to natural disasters, pandemics, government restrictions, border closures, strikes, or civil unrest.
In such cases, refunds will be limited strictly to recoverable third-party costs, and we cannot guarantee full reimbursement.
5. SERVICES & INCLUSIONS
i. The total tour price includes the following services, unless otherwise specified in your itinerary or booking confirmation:
a. Use of specially prepared 4WD vehicles equipped with camping gear;
b. All fuel costs for the duration of the expedition;
c. Meals provided throughout the expedition (as outlined in the itinerary);
d. Entry fees to national parks and other designated attractions;
e. Accommodation as specified in the itinerary (camping and/or fixed lodgings);
f. Full support from experienced, English- and Polish-speaking expedition guides;
ii. The level and type of accommodation, meals, and support may vary depending on the expedition route, group size, and environmental conditions.
NOTES:
Items not explicitly listed above are not included in the tour price.
Detailed inclusions and exclusions for each expedition will be provided in your itinerary and booking confirmation.
6. EXCLUSIONS
i. The following items are not included in the tour price and are the sole responsibility of the Traveller:
a. International and domestic flights to and from Australia (unless otherwise specified);
b. Visa fees and any associated immigration costs;
c. Personal travel insurance (mandatory – see Section 7);
d. Optional activities, such as scenic flights, diving, snorkelling tours, or cultural experiences not explicitly included in the itinerary;
e. Personal expenses, including snacks, alcohol, souvenirs, laundry, and communication costs.
ii. Any services not expressly mentioned in the Services & Inclusions section or in your confirmed itinerary are excluded from the package price.
7. TRAVELLER RESPONSIBILITIES, INSURANCES & LIABILITY
i. By booking an expedition with Adventure Spirit, you agree to the following responsibilities and conditions. Failure to comply may result in removal from the tour at your own expense.
YOU MUST:
a. Hold a valid passport and obtain all necessary visas for entry into Australia;
b. If participating in a self-drive expedition, possess a valid international driving permit and be legally eligible to drive a 4WD vehicle in Australia;
c. Be in a state of suitable health and physical fitness to participate in an expedition through remote and challenging environments;
d. Inform us in writing at the time of booking of any medical conditions, allergies, disabilities, or dietary requirements that may affect your participation or safety;
e. Follow all safety instructions given by our guides and team leaders at all times;
f. Accept shared responsibilities such as driving (if applicable), setting up camp, preparing meals, and maintaining group cooperation in remote areas.
TRAVEL INSURANCE REQUIREMENT:
ii. It is a condition of participation that all travellers obtain comprehensive travel insurance prior to departure. This must include coverage for:
a. Trip cancellation and interruption;
b. Medical emergencies and evacuation;
c. Personal accident and liability;
d. Lost, stolen, or damaged baggage.
iii. Proof of valid insurance may be requested prior to or during the tour. Adventure Spirit Pty Ltd is not responsible for any loss, injury, or costs incurred due to failure to obtain suitable insurance.
iv. Adventure Spirit operates with the highest care and professionalism; however, all expeditions involve inherent risks, including but not limited to travel in remote areas, encounters with wildlife, 4WD driving, and participation in outdoor or adventure activities. By booking and participating in an expedition, you acknowledge and accept these risks.
v. To the maximum extent permitted by law, Adventure Spirit Pty Ltd, its employees, agents, and contractors shall not be liable for any loss, injury, or damage arising from these risks, except where such liability cannot be legally excluded.
8. DATA & MEDIA
i. Adventure Spirit Pty Ltd respects your privacy and is committed to protecting your personal information. All personal data collected will be used solely for the purposes of processing your booking and providing expedition services.
ii. By participating in an expedition, you consent to photographs, video recordings, or other media capturing your participation being used by Adventure Spirit for promotional and marketing purposes. If you do not wish for your images or recordings to be used, you must notify us in writing at least 21 days prior to departure.
iii. All personal information will be handled in accordance with applicable Australian privacy laws.
9. GOVERNING LAW
These Booking Conditions shall be governed by and construed in accordance with the laws of Western Australia. Any disputes, claims, or legal proceedings arising out of or in connection with these Booking Conditions or your participation in an Adventure Spirit expedition shall be subject to the exclusive jurisdiction of the courts of Western Australia.
10. COMPLAINTS & DISPUTES
i. If you encounter any problem or issue during your expedition, you must inform your guide immediately so that it can be addressed on the spot.
ii. If the issue cannot be resolved during the tour, you must submit a written complaint to Adventure Spirit Pty Ltd within 7 days after the conclusion of your expedition.
iii. All disputes arising from your booking or participation will first be addressed through good faith mediation between the parties. Only if mediation fails may either party pursue resolution through the courts of Western Australia, in accordance with the Governing Law clause (Section 9).
